NASCAR news: Germain Racing appeal on No. 30 truck denied

The National Stock Car Racing Commission issued the following statement on Tuesday:

"On September 2, 2008, the National Stock Car Racing Commission heard and considered the appeal of Germain Racing regarding the #30 truck. The appeal concerned three penalties issued by NASCAR following post-race inspection on August 9, 2008 for the NASCAR Craftsman Truck Series event at Nashville Superspeedway.

Briefly, the penalties concern Section 12-4-A of the NASCAR Rule Book “Actions detrimental to stock car racing; Section 12-4-Q “Any determination by NASCAR Officials that the truck, truck parts, components and/or equipment used in the Event do not conform to NASCAR rules”; and Section 20B-12.8.1E “After competition, the maximum right side bed panel height exceeded the specified 39-1/2 inches.”

The penalties assessed were:

-A loss of 25 NASCAR Craftsman Truck Series Championship Truck Owner Points for owner, Steve Germain

-A loss of 25 NASCAR Craftsman Truck Series Championship Driver Points for driver, Todd Bodine

-A $2,500 fine for crew chief, Michael Hillman, Jr.

The Appellants paid the $2,500 fine prior to requesting an appeal hearing.

The Appellants acknowledged that the maximum height had been exceeded, but argued that the infraction was due to a rear spring slipping out of its perch.

The Commission found that the height violation was straightforward and that the penalties were appropriate for the infraction.

Therefore, it is the unanimous decision of the National Stock Car Racing Commission to uphold the original penalties assessed by NASCAR."

Germain Racing has the right to appeal the commission's decision to the commissioner.
