The appeal from Blue Square Real Estate subsidiary BSRE Point Wells challenges King County Superior Court Judge Dean Lum's Nov. 23 ruling that the project cannot go forward under Snohomish County land-use rules that were later voided by the state. The ruling poses a setback to developing the 61-acre industrial site at Point Wells, but won't necessarily stop it.
The judge's decision stemmed from a September lawsuit filed by the Town of Woodway, which is next door to the proposed building site on unincorporated county land, and Save Richmond Beach, which represents homeowners in the neighborhood to the south of the property.
Attorneys for Blue Square, part of the international real estate and energy company Alon Group, and Snohomish County argued that the project was protected under the old rules. Snohomish County also has decided to appeal the judge's decision, County Council Chairman Dave Somers said Wednesday.
