Man's death in boat capsizing ruled an accident

EVERETT -- The death of an Everett man in Port Gardner in May has been ruled an accident.
Richard L. Irby Jr., 49, drowned, the Snohomish County Medical Examiner's Office said this week.
Irby went missing in the water May 14 after his boat capsized near Jetty Island. Another man who had been in the boat was rescued nearby. Irby's body was recovered several weeks later.
His death was investigated by the medical examiner's office and Everett police.
Detectives determined that the boat capsized from overloading.
Irby's family Monday described him as a happy-tempered outdoorsman who spent many years as a fisherman in Alaska, California and Washington.
He was a father and grandfather who had lived in Snohomish County for about 25 years, they said.
Irby was not wearing a life jacket at the time of the capsizing. His family asks everyone, even experienced boaters, to wear their life jackets whenever they're on the water.
