TACOMA — A Pierce County judge has dismissed a rape charge filed against a man while he was principal of a Tacoma middle school.
Prosecutors said the case against Harold Wright Jr. and another man fell apart with witnesses unable to testify from memory and DNA evidence in dispute.
The News Tribune reported the action Monday means rape charges against Wright and Richy Carter cannot be refiled.
Prosecutors had said the men forced a 19-year-old woman to have sex with them at a Puyallup-area home. Both were convicted in a 2007 trial. The convictions were overturned on appeal and sent back to court for a new trial that was to begin this week.
Wright lost his job as principal of Baker Middle School five years ago after he was charged.
