SEATTLE — The city of Seattle is asking a federal judge to dismiss a lawsuit stemming from an incident where a police officer was recorded on video roughing up a man and using a racial epithet.
The Seattle Times reports city attorneys say officer Shandy Cobane said the racial epithet to control Martin Monetti Jr. during a robbery investigation and not to offend.
The motion was filed Tuesday. It also says Cobane didn’t kick Monetti in the head, as he alleges and it appears in the video of 2010 incident. City attorneys also say that even though Monetti was not arrested that night, they think he was complicit in two robberies.
Monetti’s attorney — Lorena Gonzalez — says she’s confident her lawsuit will not be dismissed.
