Sentencing rule doesn’t apply to school shooter, Ore. official says

PORTLAND, Ore. — Oregon’s attorney general says a U.S. Supreme Court ruling last summer that struck down mandatory life sentences without parole for two 14-year-olds does not apply to Kipland P. Kinkel.

The Oregonian reported the state has asked a Marion County judge to throw out Kinkel’s latest request for a new sentencing hearing, saying his case is different from the ones considered by the U.S. Supreme Court.

The attorney general’s office notes Kinkel received a nearly 112-year sentence — not a mandatory life sentence — from a Lane County judge.

Kinkel was 15 when he gunned down his parents in their Springfield home in 1998, and then killed two students and wounded 25 others at Thurston High School the next morning.

Oral arguments on Kinkel’s request are scheduled for Sept. 12.
