MOUNTLAKE TERRACE — Snohomish County prosecutors have charged an 18-year-old man with rape, a crime investigators say happened while the teen had a pending sexual assault charge involving a different girl.
Cole Krause was charged with third-degree rape Thursday in Everett District Court. Prosecutors have until mid-April to refile the charge into Superior Court.
Krause was being held on $50,000 bail. Mountlake Terrace police detective Heidi Froisland arrested him Tuesday after he provided her a statement. He denied raping the girl.
Krause allegedly said he and the girl, 16, had sex and she never said, “No.” The girl reported to police in January that Krause sexually assaulted her last fall while they were at his house. She told police she repeatedly yelled at him to stop and was crying while Krause continued to assault her.
The incident allegedly happened about eight months after a 15-year-old girl reported Krause raped her in a hallway at Mountlake Terrace High School, where Krause was a senior. She told police the assault happened after school. Police reported finding signs of a violent attack at the school. Krause, then 17, was arrested and expelled from school. He was charged in juvenile court.
At the time, a school district spokeswoman said he was being allowed to complete his remaining credits electronically.
Prosecutors earlier this year dropped the 2016 rape charge against Krause, saying the girl no longer wanted to pursue the case. The juvenile case was sealed.
Froisland wrote in a probable cause affidavit filed Tuesday that, “Several other juveniles claim to be victims but will not make a report.”
The case remains under investigation.
