Facing high L&I premiums, this Kent company called in the experts

If companies don’t understand the fine print of L&I decisions, they may be paying unfair premiums

MJ Nahal is a logistics expert. If you need stacks of food or beverages shipped across the Pacific Northwest, he’s your guy. But the Director of Fleet & Safety for Stryder Motorfreight isn’t an expert in the fine print of Washington L&I (Labor and Industries), so when faced with high premiums and a complicated employee claim, he called Stop Claims Corp.

“We’re extremely pleased with the work Stop Claims has done for us. They’ve saved us hundreds of thousands of dollars of the last few years,” Nahal says.

Investigating claims, appealing L&I decisions

“The majority of workplace injuries are legitimate, but even legitimate claims can take a life of their own,” says Kayla Orejuela, an Employer Outreach Executive and Sr. Litigation Paralegal with Stop Claims Corp.

In Stryder’s case, one of their employees was unable to work due to an injury, but it wasn’t clear whether the injury happened at work or during their commute. At first the claimant said they had pain due to their two hour commute, but after hiring a new attorney they began claiming that the injury happened while working.

Stop Claims Corp helped clarify these claims by taking the case all the way up to Superior Court. Along the way the claimant’s pain was reclassified from an occupational injury to an occupational disease. Sound complicated? There are lots of tricky details and legal terms to know when navigating L&I, which is why it’s important to have someone like Stop Claims Corp on your side.

“We took the case all the way up to Superior Court, and we won. We were able to get Stryder removed from the claimant’s account, which not only removes the problem claim but also significantly reduced their L&I premiums,” Orejuela says. “Stryder didn’t know that L&I was making an adverse decision that was against the law.”

How the Stop Claims Corp process works for you:

  • Reviewing every L&I decision to ensure benefits are fair, reasonable and curative. “If the decisions are not appropriate, we actively petition, protest, and appeal claim decisions all the way to the Board of Industrial Insurance Appeals – without the high cost of attorneys,” Orejuela says.
  • Consulting with nurse case managers and paralegals to clarify medical and legal arguments.
  • Offering vocational support to help employees return to work, navigating light duties at work, and assisting with Stay at Work reimbursement programs.
  • Liaising with L&I Industrial Insurance.
