An Everett teen-ager accused in the beating death of 15-year-old Joshua Lorbiecki will remain jailed with $250,000 cash bail, a judge decided Monday.
A lawyer for Emanuel Robert Wilson, 16, sought to have his bail reduced significantly while he, a brother and two other young men await trial on first-degree murder charges. But Snohomish County Superior Court Judge Ken Cowsert would have none of it.
Marybeth Dingledy, a public defender, said the $250,000 cash bail was too high. She asked for $50,000 bail that could be backed by a bond, something that would make it easier for Wilson to get out of jail pending trial.
The youth has several relatives in the area, including his father, who lives in Marysville. Members of his family were in court to support the request.
Dingledy pointed out that brothers Emanuel and Fernando Troy Wilson, 18, turned themselves in when they returned to the state from Texas after learning there were warrants for their arrest in the beating death. She added that Emanuel Wilson’s 16-year-old girlfriend is pregnant.
But deputy prosecutor Joan Cavagnaro told Cowsert that members of the Lorbiecki family were in court to oppose lowering the bail. She said the state has alleged it was the younger Wilson who wielded the bat that killed Lorbiecki.
"I have heard nothing today to indicate to me the bail should be decreased or increased," Cowsert said.
Matthew Dominic Teague, 18, of Lynnwood and Steven Limar, 20, of Everett also are charged.
Lorbiecki was beaten Nov. 17 in an apparent robbery attempt and left for dead on the Evergreen Middle School field. Prosecutors allege he was lured to the area on the pretext of buying marijuana and was struck in the head with a miniature baseball bat.
