Colton Harris-Moore’s defense attorney, John Henry Browne, was on KOMO Radio Wednesday morning saying that his client’s jailhouse emails and phone calls are being taken out of context.
As we and others widely reportedly, federal prosecutors are claiming the Barefoot Bandit isn’t as remorseful as he’s been portrayed. As evidence, they’ve offered up Harris-Moore’s correspondence and recordings of telephone calls. They’ve asked U.S. District Court Judge Richard A. Jones to use the materials in determining the Camano Island man’s sentence on Friday.
“He is ONLY 20 and that is a factor in all this,” Browne wrote The Herald in an email late Wednesday.

Whether Harris-Moore’s emails will make a difference will not be known until the judge rules Friday. Browne said he doesn’t believe that Jones would order Harris-Moore to serve consecutive sentences, effectively doubling the punishment.
“I hope not,” Browne said. “He is a great judge and was young once himself.”
Browne said he plans to provide the judge with full emails and conversation transcripts quoted by federal prosecutors. He says that will demonstrate the proper context.
He also said that Harris-Moore’s mother, Pam Kohler, is rumored to plan on attending the hearing. She did not attend his sentencing hearing last month in Coupeville.
