EVERETT – A judge today continued a temporary restraining order for 30 days, which gives the remaining Smokey Point RV Park residents more time to move before their utilities are disconnected.
The park is being sold to developers of Lakewood Crossing, a planned 476,000-square-foot retail center that will include Costco, Target and Circuit City stores. Some of the stores are expected to open in August.
Residents on Dec. 1 were given 45 days to move out of the park at 28th Drive NE, just south of 172nd Street NE, and told that those who weren’t moved by Jan. 15 would be subject to arrest and their belongings moved out by authorities.
Eight residents filed a lawsuit and were granted a temporary restraining order last Friday. They’re arguing that the park should be subject to the state law that governs mobile home parks and that residents should have been given a year’s notice to vacate.
Snohomish County Superior Court Judge Gerald Knight said he didn’t have enough information to make that decision and instructed the two sides to set a trial date in about 30 days.
In the meantime, the park’s owners cannot disconnect the utilities.
