BURLEY, Idaho — A former 5th District Court magistrate judge who previously pleaded guilty to driving under the influence has been cited with driving with an open container of alcohol.
The Times-News reports that Nicole Cannon, 43, was stopped June 7 by a Cassia County sheriff’s deputy.
She’s scheduled to appear in Cassia County court July 1.
Cannon in December pleaded guilty to driving under the influence and was fined $1,278.50 and ordered to attend 16 hours of alcohol/DUI education classes.
Cannon was charged in April 2012 after she was stopped by a Boise police officer. Two tests found her blood-alcohol level to be 0.239 and 0.221, nearly three times the limit at which a person is considered legally intoxicated.
Cannon resigned her judgeship in late June 2012.
