DALLAS, Ore. — A grand jury has decided not to indict a West Salem High School choir teacher accused of leaving the scene of a collision with an 8-year-old boy.
Police had arrested 52-year-old Kimberly McConnell on a charge of failure to perform the duties of a driver to injured persons.
Her lawyer says the boy, a neighbor, skateboarded into the car, his family did not want to call 911 or an ambulance, and McConnell left only briefly to take her son to school, while her husband stayed behind.
The boy suffered a broken leg.
A statement from the Polk County district attorney’s office Wednesday said the grand jury heard sharply conflicting testimony, including that of McConnell, during two weeks of deliberation. It said Tuesday’s decision ends any prosecution.
