A King County judge will not reconsider a decision that would have allowed an area flood control board to become involved in the dispute over annexation of land at Island Crossing by the city of Arlington, the group’s lawyer said Thursday.
The Stillaguamish Flood Control District may appeal the decision, said attorney Henry Lippek.
Superior Court Judge Michel Fox ruled that the district doesn’t have standing to ask the state Boundary Review Board for Snohomish County to decide whether the proposed annexation is valid.
The flood district objected to the addition of more than 100 acres to Arlington, and allowing commercial development on the farmland near I-5. It argued that the proposed development would affect flooding, even though the proposed annexation does not include flood district land.
The boundary board can invoke jurisdiction and determine if municipal annexations are in the public interest.
Lippek acknowledged that the main battle over the controversial annexation will be fought before the Central Puget Sound Growth Management Hearings Board, which has already rejected the plan. The growth board’s decision has been appealed to Snohomish County Superior Court by auto dealer Dwayne Lane, who has pushed for annexation and zoning to allow a new car lot near I-5.
