OLYMPIA — A man who used an AK-47 to target police officers during a methamphetamine-fueled shooting spree at a crowded bus and train depot in downtown Spokane will be sentenced for a third time.
Jason Allen Graham has already been sentenced twice for the January 2002 shooting spree. After the first was overturned on appeal, Spokane County Superior Court Judge Maryann Moreno resentenced him to 82 years. The judge said the sentence was too long for Graham’s offenses, but because of the multiple violent crimes he was charged with, she couldn’t give him any less time.
In a unanimous ruling Thursday, Washington’s Supreme Court disagreed. They said judges do have discretion to give lesser sentences in cases such as Graham’s, where multiple charges can result in an excessive punishment. They sent the case back for a third sentencing hearing.
Graham was wounded by police during a shootout, but no one else was injured.
