SPOKANE, Wash. — Spokane County Prosecutor Steve Tucker says a homeowner will be charged with manslaughter for shooting a suspected car thief driving away in his SUV.
Tucker told KREM that Gail Gerlach will not be booked until his arraignment.
The prosecutor’s office relayed the charge Wednesday to Gerlach’s lawyer who said he’s disappointed with the decision and looking forward to resolving it in court.
Gerlach said he shot Brendon Kaluza-Graham in March because Gerlach thought he saw him raise a gun. The 25-year-old died at the scene.
No gun was found in the car. Police found two sets of shaved keys, a flashlight and a screwdriver on the body.
Gerlach has no criminal history and is legally allowed to carry a concealed weapon.
