VANCOUVER, Wash. — A new trial has been ordered for ex-Beaverton, Oregon, police Officer Christopher Warren whose child rape conviction in Vancouver was thrown out because of a mistrial.
The Oregonian reports a Clark County Superior Court judge ordered the new trial this week, although the date has not been set.
A jury convicted the 34-year-old Warren in October of raping a 5-year-old girl with a pencil. The mistrial was declared in December after a juror admitted reading a newspaper article about the case in violation of jury instructions.
Warren was fired twice from the Beaverton Police Department, first in 2011 for lying in an internal investigation. He won reinstatement but was fired again in 2013 after he was charged with child rape.
His lawyer says he was falsely accused.
