LONGVIEW — A speeding ticket issued to a retired Cowlitz County judge by a traffic camera in Longview has been thrown out.
A Clark County judge who was brought in to hear the appeal ruled Monday that the city failed to prove that Jim Warme or his wife was driving the speeding car through a school zone.
The Daily News reports Judge Robert Lewis said the ticket could have been issued under another ordinance to the car’s registered owner without identifying the driver.
Warme was ticketed a year ago when a camera caught his car going 31 mph in a 20 mph school zone. He appealed, saying the camera captures image of cars, not the drivers. He says it’s unconstitutional for the accused to have to prove they weren’t driving.
