OLYMPIA — The Washington Supreme Court has upheld murder convictions against two men in a 2006 kidnapping, torture and execution in Spokane County.
Sebastian Esquibel’s body was found under a woodpile, shot in the back of the head after a drug deal gone bad. Among those involved, Robert A. Brown was convicted of felony murder, with kidnapping as the underlying felony, and Theodore Kosewicz was convicted of aggravated first-degree murder, with kidnapping being the aggravating factor.
On appeal, both defendants had their underlying kidnapping convictions thrown out because of flaws in their charging papers, and the Supreme Court had to decide whether their murder convictions should remain. The justices all said they would uphold Kosewicz’s murder conviction, and by a 5-4 majority Thursday they voted to uphold Brown’s as well.
