TACOMA — Citing “prosecutorial vindictiveness,” a Pierce County judge has dismissed a case against a 48-year-old woman accused of abusing her daughter.
Superior Court Judge Edmund Murphy on Monday sided with defense lawyers who argued that prosecutors filed charges against Lynn Dalsing to gain an advantage in a civil lawsuit she filed against Pierce County.
The News Tribune said that Murphy’s ruling dismisses child rape and other charges against Dalsing. Those charges cannot be re-filed.
Prosecutors first charged Dalsing in 2010. Those charges were dismissed in 2011. She later sued the county for false arrest.
The judge noted that prosecutors re-opened a criminal investigation against Dalsing in 2013 after she won a series of favorable rulings in her lawsuit.
In a statement, deputy prosecutor Jared Ausserer says it’s the duty of prosecutors to file charges where there’s strong evidence of guilt.
