When I read that our Supreme Court has struck down Initiative 722, I became confused. The last time I read the Declaration of Independence, about five minutes before writing this, I saw where paragraph two states, in part, “…Governments are instituted among Men, deriving their just powers from the consent of the governed…”
Here is where I am confused. How can a proposition, passed by the people (“the governed”) be ruled as not in the best interest of the people? What is the remedy? Do we have to pass a constitutional amendment for every proposition to keep the court from usurping our right to govern ourselves?
The reason the court gives is that the proposition had multiple subjects. The subject of the proposition was taxes. Our founding fathers were light years ahead of their time in drafting the Constitution based on the principals of the Declaration of Independence. They never envisioned a judicial system where the members could not read.
