It seems that judicial activism exists in the eye of the beholder. If the jurists render an opinion agreeing with yours then they do their job appropriately. If their opinion disagrees with yours they become activists.
How else do you explain the rally to support the nuclear option in the Senate? It seems these folks who previously decried judicial activism really want it active in their favor.
