This replies to the Oct. 13 letter by Washington National Guard’s Capt. Chris Lekas concerning ESGR and employment problems related to his military affiliation. Employer Support of the Guard and Reserve is a Department of Defense organization providing free education, consultation, and if needed, mediation for employers of Guard and Reserve employees. ESGR helps resolve employer-employee disputes related to military service.
ESGR supports the military command in pursuing alleged violations of USC 43, Uniformed Services Employment and Reemployment Rights Act. Knowledge and application of proper procedures regarding USERRA is important for service members to know. Reserve/Guard units routinely brief their members about ESGR/USERRA. In relatively few instances, the U.S. Dept. of Labor takes over such cases as experienced by Capt. Lekas when settlement isn’t reached with ESGR’s assistance. In extreme instances, the U.S. Department of Justice enters.
There is no statute of limitations regarding such complaints, so Capt. Lekas is free to pursue his case with Department of Labor as he initially did nearly two years ago.
