MARYSVILLE — The family of a worker who fell to his death at a Marysville construction site sued a contracting company in Snohomish County Superior Court last month.
The complaint alleges that leaders at J&AP Construction and Cornerstone Homes did not follow “applicable safety rules” that resulted in the death of Sergio Rolando Mejia-Perez.
Cornerstone Homes, based in the greater Seattle area, builds houses in Washington and Idaho. A spokesperson for the contracting company did not immediately return a request for comment.
On March 23, 2023, Mejia-Perez, 30, was working as a subcontractor for Cornerstone at the 8800 block in Marysville, according to the lawsuit. He was working on an exterior wall when he fell 20 feet from the third story. He was pronounced dead at the job site.
He is survived by his young son and parents.
Mejia-Perez “consciously suffered pain, as well as an impending fear of death,” before he passed, the lawsuit read.
The lawsuit alleges the employers did not ensure a “fall protection system” for worksites above 4 feet off the ground.
State law requires employers to provide a workplace “free from recognized hazards that are causing or likely to cause serious injury or death” to employees.
“The defendant allowed illegal, unsafe, hazardous practices resulting in an unsafe jobsite and, ultimately, Sergio Rolando Mejia-Perez’s death,” the lawsuit reads.
It was unclear how long the deceased had been working at J&AP Construction.
The family’s attorney at Herman Law Group was unavailable for comment Friday.
