Skagit County judges dismiss DUI challenges

MOUNT VERNON, Wash. — Prosecutors are the winners in a court decision in Mount Vernon that may affect drunken driving cases across Washington.

Two Skagit County judges have dismissed challenges to alcohol evidence processed at the state toxicology lab.

The judges ruled on 51 cases that were consolidated for a three-day hearing earlier this month. Defense lawyers challenged the work of the state toxicology lab that certifies breath test machines. State officials said minor problems should not invalidate all evidence.

The judges have denied the defense motions to dismiss the alcohol evidence.
