OLYMPIA The state Supreme Court on Wednesday will consider whether King County should be allowed to count hundreds of disputed ballots, enough to decide the prolonged race for governor between Dino Rossi and Christine Gregoire.
The high court issued an order today setting the hearing for 9:30 a.m. Wednesday in the Temple of Justice. The proceeding will be televised live on TVW.
The court will hear the appeal filed by the Democratic Party, King County and the Secretary of States Office of a decision blocking the processing and counting of 573 ballots.
On Friday, a Pierce County Superior Court judge granted a state Republican Party request to block the counting of the recently discovered ballots. The judge ruled that because the ballots had been previously rejected they could not be reexamined for possible inclusion in the hand recount.
Democrats and King County appealed, saying that the ballots were rejected by mistake and through no fault of the voter. They said the law allows errors to be corrected and votes tallied.
