Marc Abarcus’ Friday letter details which president appointed the justices who allowed seizure of private property by the government.
On the surface, his analysis seems to indicate that it was Republican presidents who are to blame. But we need to look deeper. Who was in control of the Senate when these justices were confirmed?
All five justices in the majority were confirmed by a Democrat-controlled Senate. In the minority were two justices confirmed by Democrats and two justices confirmed by Republicans. One of the justices in the minority confirmed by Democrats was Justice Thomas, who was only confirmed after a long fight by Democrats to keep him off the bench.
Two justices were appointed and confirmed by Democrats: Justice Breyer and Justice Ginsberg. Both voted for increased power by the government and less rights for the individual.
Two justices were appointed and confirmed by Republicans; Justice Scalia and Justice O’Connor. Both voted that government may not seize private property to give to other private parties.
So, nice try Mr. Abarcus, but a true analysis shows that this decision was the result of Democrats controlling the Senate. Yes, Democrats still hold the blame for our sudden loss of rights.
