SANTA CLARA, Calif. — Colin Kaepernick called some media reports “completely wrong” regarding an April 1 incident with a female at a Miami apartment that police classified as suspicious. Meanwhile, Miami police said an investigation remains ongoing.
“We have to examine evidence and wait for some tests to come back, including toxicology reports,” Police Chief Manuel Orosa told the Miami Herald on Friday. “We can present it to the state attorney, and they can decide whether to continue. … It’s too early to determine what the evidence indicates.”
Kaepernick took to Twitter on Friday morning and commented for the first time since news broke Thursday about his alleged involvement with a woman, who claimed she partied with the 49ers quarterback and two other NFL players before she passed out naked and woke up the next day in a hospital bed.
“The charges made in the TMZ story and other stories I’ve seen are completely wrong,” Kaepernick posted in his first tweet. “They make things up about me that never happened.”
On Friday, TMZ stood by its assertion that the investigation is for sexual assault. A TMZ.com story said, “As we reported, a law enforcement source at the Miami PD told us Kaepernick is a suspect in a sexual assault case.”
The story added: “The Miami PD also told USA Today he was a suspect in a sexual assault case — but then backtracked and said it was for a ‘suspicious incident.”’
TMZ cited a Miami Police Department official in reporting that “a rape kit was administered on the woman at the heart of the Colin Kaepernick investigation.” The (Miami) Herald reported the same, also citing sources.
On Thursday, Miami police spokesman Rene Pimental told the Bay Area News Group: “There’s no evidence of a crime or a sexual assault. This report is simply an incident report taken at the woman’s request.”
“I take great pride in who I am and what I do, but I guess sometimes you have to deal with someone who makes things up,” Kaepernick tweeted.
“I want to thank all of the people who have shared their encouraging sentiments. I assure you that your faith is not misplaced.”
The 49ers said Thursday they were aware of the reported incident, issuing a statement from general manager Trent Baalke that said in part they were “in the process of gathering the pertinent facts.”
An unnamed woman filed a report with Miami police on April 3, alleging she made drinks at an apartment for Kaepernick, 49ers teammate Quinton Patton and Seattle Seahawks receiver Ricardo Lockette, a former 49er and a close friend of Kaepernick. She claimed Kaepernick followed her into a bedroom, began undressing her, he left the room, they did not have sex, and she mysteriously awoke the next day in a hospital. The Miami police incident report said the woman claimed to have a previous sexual relationship with Kaepernick.
The Herald reported Friday that the woman was transported to the hospital by Miami Fire Rescue.
X-A-M Sports, which represents Kaepernick, issued the following statement Friday: “We stand by Colin 100 percent and are fully confident that the truth will be evident once the facts come to light regarding this matter. We thank you for supporting Colin.”
TMZ Sports reached out to MusclePharm CEO Brad Pyatt, whose brand is endorsed by Kaepernick, and Pyatt said: “Colin’s been a standup athlete for us. I’d be shocked if this were true.”
Among those coming to Kaepernick’s defense was 49ers left tackle Anthony Davis, who tweeted: “It should be illegal to assassinate someone’s character like that. Be careful what you wish for. It’s cutthroat out here.”
