MONROE — The Monroe School District is planning to sue the owner of the building that once housed its alternative school.
The district is still paying $66,346 a month on the lease for the building.
Earlier this year, the school district decided to move the Sky Valley Education Center, its alternative school, from the property at 17072 Tye St. SE to the former Monroe Middle School. The district said it sent two notices — one in February and one in July — to terminate its lease agreement with Fryelands Sixth Avenue Associates LLC, the property owner.
But the company said the district had no right to terminate the lease.
The district said it has continued paying rent for both buildings as a precaution to avoid claims of default and potential penalties.
Last week, the Monroe School Board voted unanimously to sue Fryelands Sixth Avenue Associates. The district is asking a King County Superior Court to terminate the lease, spokeswoman Rosemary O’Neil said.
The decision to sue was made after both parties failed to reach an agreement during mediation, she said.
The Summits Program, a cooperative program that serves students with special needs, is still housed at a second building at the Tye Street property although the district plans to move it to another facility over the winter break, O’Neil said.
Fryelands Sixth Avenue could not be reached for comment.
The district started leasing the buildings on the property in September 2002.
